Agreement to Terms

Welcome to Daryna. By accessing or using our mobile application, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this app.

These Terms of Service constitute a legally binding agreement between you and Daryna regarding your use of the app.

Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Daryna app on your personal device
• Access and use the app for your personal, non-commercial purposes
• Create, upload, and share yoga-related content
• Interact with other users and their content

This license does not include the right to:

• Modify or copy the app materials
• Use the materials for any commercial purpose
• Attempt to decompile or reverse engineer any software contained in the app
• Remove any copyright or proprietary notations from the materials
• Transfer the materials to another person or mirror the materials on any other server

User Accounts

To use certain features of Daryna, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use Daryna.

User Content

Content Ownership

You retain all ownership rights to the content you create and share on Daryna. However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your content solely for the purpose of operating and improving the app.

Content Guidelines

You agree that all content you share on Daryna will:

• Be related to yoga, wellness, or fitness activities
• Be appropriate for a general audience
• Not infringe on any third party's intellectual property rights
• Not contain harmful, offensive, or illegal material
• Not promote violence, discrimination, or harassment
• Not contain spam or misleading information

Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice. Repeated violations may result in account suspension or termination.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations
• Impersonating another person or entity
• Harassing, bullying, or threatening other users
• Collecting or storing personal data about other users without consent
• Interfering with or disrupting the app's functionality
• Using automated systems or bots to access the app
• Attempting to gain unauthorized access to the app or other users' accounts
• Uploading viruses or malicious code

Intellectual Property

The Daryna app, including its original content, features, and functionality, is owned by Daryna and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

Third-Party Links

Daryna may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party content or services.

Disclaimer of Warranties

Daryna is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that:

• The app will function uninterrupted or error-free
• Defects will be corrected
• The app is free of viruses or harmful components
• The results of using the app will meet your requirements

Limitation of Liability

To the maximum extent permitted by law, Daryna and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from:

• Your use or inability to use the app
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the app
• Any bugs, viruses, or similar items transmitted through the app
• Any errors or omissions in content
• User content or the defamatory, offensive, or illegal conduct of any third party

Indemnification

You agree to indemnify, defend, and hold harmless Daryna and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the app
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit or share through the app

Termination

We may terminate or suspend your account and access to the app immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the app will immediately cease.

You may also delete your account at any time through the app settings. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the app shall be resolved in the appropriate courts.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our app after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the app.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Daryna regarding the use of the app and supersede all prior agreements and understandings, whether written or oral.
